American Guilt: How America Convicts the Innocent (Paperback) (ISBN-13: 9798190389883)

One underscore. A police officer typed a username with one underscore instead of two - and an innocent man served every day of a prison sentence for the most despised crime there is. The error sat in the file the whole time, visible to anyone who looked. Nobody looked.

That wasn't a breakdown. That was the system working exactly as built.

America was founded on a promise: better that ten guilty men go free than one innocent suffer. Ben Franklin raised it to a hundred. That promise is dead - and American Guilt is the autopsy.

Since 1989, nearly 3,800 Americans have been formally exonerated of crimes they did not commit. In roughly a third of those cases, there was no crime at all - an accident, an illness, a tragedy dressed up as murder because a terrified community needed somebody to pay. The best research says at least 1 in 25 people sentenced to death are innocent. Those are the ones we caught.

Marcus Garvin takes the machine apart piece by piece: the sheriff's Facebook post that convicts a man in the comments before he meets his lawyer. The interrogation room that turns terrified teenagers into "confessed killers." The jailhouse market where testimony is bought with freedom. The junk science - bite marks, burn patterns, hair "matches" - that dressed rage up in a lab coat. The prosecutors who ask can I win it instead of did he do it. The appeals courts that never re-check the facts. And the quiet lie that holds it all together: if he were innocent, somebody would have caught it by now.

You'll meet Juan Rivera, convicted three times for a murder DNA proved he didn't commit - while a government ankle monitor said he was home. Sandra Hemme, who served 43 years while evidence pointing at a police officer sat buried in the file. The Central Park Five. The day-care workers convicted of impossible crimes during a national panic. Cameron Todd Willingham, executed on fire "science" that was folklore. And the empty chairs - the real killers who stayed free, and killed again, while the wrong man sat in their place.

But this is not just a book of outrage. It's a blueprint. American Guilt closes with the questions nobody in power will ask - and answers them: the interrogation method that ends false confessions without losing true ones. The dual-verdict rule that would make a conviction require two independent decisions instead of one. The "roads not taken" file that would make tunnel vision visible in the paperwork. Real fixes, already working somewhere, waiting only for the will.

Every case in this book is real. Every number is documented. And the next jury summons could be yours.

For readers of Just Mercy, The Innocent Man, and anyone who has ever watched a mugshot cross their feed and thought: glad it's not me.

Read this book before you say that again.
