Commander or Congress?: The Constitutional Battle Over Who Decides When America Goes to War (Paperback) (ISBN-13: 9798187031757)

For more than two centuries, one constitutional question has remained unsettled:

Who has the authority to take America to war?

The Constitution grants Congress the power to declare war while naming the President Commander in Chief of the armed forces. Yet since World War II, presidents of both political parties have repeatedly committed American forces to combat without formal declarations of war.

How did this happen?

Did the Constitution change?

Or did presidential precedent quietly replace constitutional design?

In Commander or Congress?, constitutional researcher Samuel Carter traces the evolution of American war powers from the debates of the Constitutional Convention through Korea, Vietnam, the War Powers Resolution of 1973, the Gulf War, Kosovo, Afghanistan, Iraq, Libya, Syria, and the modern War on Terror.

Drawing upon the Constitution, the Federalist Papers, Supreme Court decisions, presidential records, congressional debates, and historical evidence, this book examines one of the most important constitutional controversies in American history.

Inside you'll discover:

- Why the Framers intentionally divided war powers between Congress and the President

- Why the War Powers Resolution remains one of America's most controversial laws

- Why nearly every modern president has questioned the Resolution's constitutionality

- How Congress gradually shifted from declaring wars to issuing broad military authorizations

- Why the Supreme Court has largely avoided settling the debate

- Whether executive military authority has expanded beyond the Constitution's original design

Rather than promoting partisan talking points, Commander or Congress? invites readers to examine the historical record, constitutional text, and legal arguments for themselves.

The Constitution's question remains unfinished.

Its answer belongs to every American.
